You agree to be bound by these terms and conditions when using, or buying products off, this web site.
We may update these terms and conditions from time to time so please check them regularly—with each order—at the order will be governed by the terms and conditions in place at the time of the order (subject to any subsequent amendments required by law).
Purchase
To buy, select the number of products you wish to buy and click "Add to Basket". The "Shopping Cart" page will appear, showing details the products you have added to your Shopping Cart.
From here you may adjust the quantity of products you want, continue shopping or proceed to checkout to buy the contents of the Shopping Cart.
Click on the "Checkout" button and you will be transferred to the Checkout page, which will display the value of the products in your Shopping Cart and the postage price (if applicable). Product will be delivered to the UK, Northern Ireland and Republic of Ireland only. At this time you may enter a discount code (if you have one) and the price will be altered accordingly. Dr Zak reserves the right not to accept any order.
You will be asked to select payment method. All payment information is taken via a secure server. No credit card details are kept by Dr Zak. All products are available for purchase using either Cheque (by post to us), Mastercard, Visa, Visa Delta, Visa Electron, Visa Purchasing, Switch and Solo. You will need to provide a delivery address which should be your card billing address. Delivery timings are estimates only.
When you are happy with the details that you have provided, you can confirm your order by clicking the "Payment" button which reflects the method of purchase you wish to use. This will create your order, which will be sent to Dr Zak. You will receive an e-mail from us confirming receipt of your order. Orders will not be accepted until delivery is made by Dr Zak. It is your responsibility that someone is available at the delivery address to accept, via signature, receipt of the products. This signatory does not have to be the same person as the name provided on the delivery package.
Our contract
When you submit your order to us, we will e-mail you confirming receipt of your order. This confirmation will include details of the products ordered. Your order will constitute an offer to Dr Zak to purchase the products in question. We will transfer your payment on receipt of the order, although if we are unable for any reason to process delivery of the order we will give you a full refund for the undelivered products. Dr Zak will not be deemed to have accepted your order and no contract will have been formed, until your order has been dispatched to your delivery address. Where we have dispatched only some of the products contained in an order, the order for the remaining undispatched products will not be deemed accepted until they themselves are dispatched.
You agree that communications between you and Dr Zak will be made by e-mail or other electronic means, and you consent to receive all communications from Dr Zak in an electronic format. By agreeing to these terms and conditions, you agree that you have elected to enter any agreement for the purchase of products electronically and to receive any required communications, notices or updates in an electronic format.
Without in any way limiting our liability for death and/or personal injury caused by our negligence or breach of duty, Dr Zak will not be liable for any direct, indirect or consequential loss. Without limiting your statutory rights, Dr Zak will not be held liable for any failure to fulfil our obligations hereunder caused by events beyond our reasonable control. No failure by Dr Zak to enforce a right hereunder will be deemed a waiver of that right.
Any condition or term herein deemed for any reason invalid or legally unenforceable will be deemed severable from these terms and conditions and will not affect the enforceability of the remaining terms and conditions. These terms and conditions and the content of this site as well as any dispute of any sort that might arise between you and Dr Zak, shall be governed by English law, and you hereby submit to the exclusive jurisdiction of the courts of England. All communications from you regarding any legal action shall not be accepted by electronic means and shall only be accepted if sent in writing to our head office address.
Returns
Cancellations. Without affecting your rights as set out in the paragraph on Defective Products (below), you may cancel your order at any time prior to expiry of 7 days following the actual date of delivery of any ordered products by writing to us at info@Dr Zak.co.uk or calling us on the telephone numbers detailed below between 09:00 and 17:00 Monday - Friday, indicating any reason for the return. Where you so cancel your order after we have dispatched the products, you will at your own expense return the ordered products to us, unopened and in as good a condition as when received by you, by returning the products to us at Returns at the address detailed below. You will receive a full refund credited to your payment card in respect of any validly cancelled order within 30 days.
Return of Defective Products. We will only accept the return of, and refund, opened products where they are Defective Products as described in the following paragraph. A product is defective where the products content does not otherwise match the description of the product ordered (Defective Product). In the event of receiving a Defective Product please immediately contact us on the number detailed below giving us the Best Before Date and Batch Number. We will pay for you to return the Defective Product and be able to either request a replacement product or cancel the order. Where you choose to cancel the order you will receive a full refund credited to your payment card.
c. Products Delivered in Error. Where products are delivered in error (damaged, wrong quantity etc.) please contact us immediately at info@Dr Zak.co.uk or call us on the number below between 09:00 and 17:00 Monday - Friday and arrangements shall be made with you for their collection and replacement or for their return to us at our cost.
Availability/Prices
Where products are unavailable for purchase, this will be marked on the relevant product information page. However, the availability of a product cannot be guaranteed by its availability being shown on the relevant product information page. Despite our best efforts to keep the pages as up to date as possible, the availability of a product may alter in advance of the information on the relevant product information page being updated; this may lead to Dr Zak being unable to accept an order. In these circumstances - subject to cancellation by you, which you are free to do at any time prior to seven days following delivery by Dr Zak—Dr Zak will keep your order open until fresh stocks of the product are received. Dr Zak will inform you by e-mail if it is unable to process, or otherwise accept, your order within 30 days of the date of your order, in which case you will be given the option either of being reimbursed the value of your order or of resubmitting or substituting your order.
Occasionally, despite our best efforts, there may be an error in the price attributed to a product on the relevant product information page. In these circumstances, we will charge the lower of the actual price and the price indicated on the product information page.
Prices are displayed throughout the website in GBP (pounds sterling). For orders with a billing address in the Republic of Ireland, your credit card company will convert the GBP price to Euros on your credit card statement.
Children
If you are under 16, you should only purchase products through this website with the permission and involvement of a parent or guardian.
No warranty
This site is controlled and operated by Dr Zak from its offices in the UK. Dr Zak makes no representation that material in the site is appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent that local laws are applicable.
Dr Zak uses reasonable efforts to update the site (“the Site”), but makes no representation or warranty in respect of accuracy or lack of errors.
Use of the Site is at the risk of the user. Dr Zak takes no responsibility for direct, indirect or consequential loss from use of the Site and all implied warranties are excluded to the extent permissible under English law.
Dr Zak accepts no liability for viruses infecting the user following its use of the audio, video, data or text on the site.
